Environmental concern world over has gained momentum today. Violation of various enviro-human rights has now become a prime concern for national Governments. Right to life has to mitigate the challenges, involved in safeguarding the human right to environment. Problem arises as to the obscurity and relativity of the scope and ambit of the right to environment. In relation to first world countries the scope is different which does not fit with the conditions prevailed in less developed countries. Even within a country the meaning and scope of the right to environment is not same and similar for all people of the country. Right to environment often comes in controversy with other rights such as right to development, right to livelihood, right to housing, right to shelter.
The book mainly concentrates on emerging dimensions of the scope and ambit of the right to environment in India under international, national and regional scenario. The Book sets out the polemics of global, federal and local environmental law and management to find protection of regional problems of pollution. Under the light of ‘think globally and act locally’ and agenda 21, the book tried to solve local environmental problems by adopting community oriented environmental governance. The book has covered an important aspect of human right to environment that is the role played by the higher Judiciary in the emergence of the right.
Mohd. Sharif Uddin (b. 1970) did his Post Graduation in Law form Aligarh Muslim University and obtained Ph.D. Degree in Environmental Law from North Bengal University, Darjeeling, West Bengal. He has co-authored a book entitled “Water Pollution and Law” Saloni Publication, New Delhi (2004). His area of interest is Environmental Law and Human Rights and its efficacy in the promotion and well-being of the people of North-Eastern Region of India. He has published many research papers in the field of Environmental Law. He is intensely engaged in teaching and research on the theme of ‘Human Right to Environment in India’ for over last ten years. At present he is working as a Principal in the Shillong Law College, Shillong Meghalaya. As a writer and seminarian, he contributed little in the field of human right to environment.
